What did the FinCEN residential real estate rule change for cash home sales?
Less than the headlines suggested, and right now nothing. The duty fell on settlement and title professionals reporting on the buying entity in transfers to legal entities and trusts — not on the person selling. As of September 12, 2026, a Fresno, California homeowner selling a house for cash has no FinCEN Real Estate Report obligation of their own: the requirement was postponed to March 1, 2026, then vacated by a federal court on March 19, 2026, with the appeal pending. Expect a buyer to produce entity documents anyway.
Can a cash sale really close in seven days, or is that just marketing?
The two claims are not equally supported. California Insurance Code section 12413.1 bars a title, escrow or underwritten title company from disbursing escrow funds until the money is collected. Cash and electronic payments may go out the same business day; deposits given next-day availability under Part 229 of Title 12 of the Code of Federal Regulations wait a business day; drafts wait until the drawee actually pays. The “guaranteed close in 7 days” version counts from the day the file is clear, not the day the seller said yes. In between sit the preliminary title report, payoff demands, and recording — which is local and physical.
